By accessing this app, you hereby accept these terms and conditions in full. Do not continue to use our app if you do not accept all the terms and conditions as stated herein.
The following terminology applies to these Terms and Conditions: “Client”, “You” and “Your” refers to you, the person or company accessing offers, publishing offers, or otherwise using this app and therefore accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to Local Passports LLC. “Party” or “Parties” refers to the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Copyright
All images, audio, video, logos, marketing materials or other content are all copyrighted and under the control of their respective owners. Subject to the license below, all intellectual property rights are reserved.
You may view, download for caching purposes only, and print pages from the app for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.
You must not:
- republish material from this app (including republication on another app);
- sell, rent or sub-license material from this app;
- show any material from this app in public;
- reproduce, duplicate, copy or otherwise exploit material on our app for a commercial purpose;
- edit or otherwise modify any material on this app; or
- redistribute material from this app except with express written consent.
Acceptable Use
You must not use our app in any way that causes damage to it or impairs its availability, economic viability, or accessibility. You must not use our app in any way that is unlawful, illegal, fraudulent, or harmful.
Restricted Access
We reserve the right to restrict access to areas of our app at our discretion. You agree to not access any parts of our app, especially those behind a paywall, without first paying for that access or otherwise gaining express permission. You further agree to never access, infiltrate, break, or compromise our databases or our customer and/or financial data (except your own, as provided), or similar data of a sensitive nature.
If we provide you with a user ID and password to enable you to access restricted areas of our app or other content or services, you hereby declare that that user ID and password will be kept secret and confidential.
Venue Content
In these terms and conditions, “your venue content” means material submitted by venues (including, without limitation, text, images, audio material, video material and audio-visual material) that you submit to our app. You grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use your venue content in any existing or future media. You also grant us the right to sub-license these rights.
Your venue content must not be defamatory or libelous. It must not infringe any copyright, trademark or legal or moral right of any third party. You must not submit any user content that is illegal or unlawful.
Terms Revisions
We may revise these terms and conditions from time-to-time, as necessary, without prior notice. The revised terms will apply to your use of our app from the date of their publication on our website.
Voucher Revisions
We reserve the right to change the coupons, vouchers and discounts included in any package or service that we sell or otherwise provide, including removing them completely, even after purchase, and at any time and without prior notice or consent, due to unforeseen availability changes. Coupons, vouchers, or discounts may be removed, altered, and/or added at any time.
Waiver and Indemnification
You hereby agree that all offers made by venues or other third parties in our app are not under our control, and that said third parties are entirely responsible for the fulfillment of their own individual offers, respectively. You further agree that we are not liable for any physical, financial, emotional, or any other type of harm you may experience while interacting with or attending these venues.
Venues hereby agree to hold us harmless for any injury or harm that may be caused by anyone using our website or app to seek or gain entrance into their venue, service, or attraction.
All participating venues, fundraisers, and customers agree to indemnify us against all claims arising out of your use of this website or application, or its use by others. This includes all costs incurred by us in defending against such claims.
Venue Responsibilities
Venues participating on our platform agree to:
- fulfill the terms of their voucher, coupon or advertisement fully for each passport holder in an ethical and professional manner.
- give high-quality customer service to each passport holder in regard to any issue related to their service, facilities, attractions or transactions.
- sell the passport ONLY through their own unique QR code.- validate each passport voucher at the time of its use (not necessary if the venue doesn't mind the voucher being used multiple times)
IMPORTANT NOTE: Local Passports LLC reserves the right to cancel any voucher or offer at any time at our sole discretion and for any reason.
Fundraising Organization Responsibilities
Organizations raising funds on our platform hereby agree to.
- follow Local Passport's "Code of Ethics" while selling the passport.
- obey all federal, state, and local laws and statutes.
- present the passport to customers in a professional, courteous, and friendly manner.
IMPORTANT NOTE: Local Passports LLC reserves the right to cancel any fundraiser if we find, in our discretion, that our platform is being used inappropriately.
Assignment
We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
Severability
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, other provisions will continue in effect.
Entire Agreement
These terms and conditions constitute the entire agreement between you and us in relation to your use of our app.
Governing Law
These terms and conditions will be governed by Utah law.
